Q2. POCSO ACT – Illegal arrest and detention by Police. Accused picked up fm Res. at 5pm on a Sat. on d pretext of an enquiry by IO, FIR was registered same day at 12:30pm and stamped Mon. but no arrest memo on Sat. – arrest memo in place on Sun. at 6:30pm. n accused produced before Magistrate on Mon. – Accused under police control on Sat./Sunday (upto 6:30pm) accused could have been produced before Duty M. (weekend closure)—illegal detention—police empowered to arrest w/o warrant in cognizable cases, but it also requires them to justify in writing?
Advocate Ashvin Khillare answered:
Therefore, keeping the accused under police control from Saturday 5 pm until Sunday 6:30 pm without the mandatory arrest memo and producing only on Monday likely constitutes illegal detention. Also, police are expected to produce the accused before the duty Magistrate over the weekend if custody continuesThis underscores the accused’s right against illegal detention and highlights the police’s procedural duty to comply with arrest protections and timely magistrate oversight. The defense can challenge this detention on grounds of illegal custody due to breach of the 24-hour rule and non-compliance with arrest memo requirementsFeel free to call me or text me for for more details.
Q3. Received notice even after paying 1 m salary. I resigned from Company A on 1st Aug without serving the notice period of 1 month. However, after my resignation they did not release my salary for July. As per employment contract, I was supposed to serve 1 month notice period or give 1 month salary. Now even though they have not released the payment of 1 month, they are harrasing me by sending legal notice stating to join back immediately or to pay 1 m salary. What should I do? What sort of harm can this notice cause me?
Advocate Ashvin Khillare answered:
If you not willing to join again that company so that you reply them to adjust July month of your salary in lieu of one month notice period. Your salary already they are holding against your notice period so that there is no question of further harm in case your July month salary is not sufficient to one months notice period then you are liable to pay the differential amount.
