Legal Articles
Q1. I am an accused in an FIR registered under the Bharatiya Nyaya Sanhita (BNS). The police have arrested me, and my family is scared. What should I do immediately to get bail?
Advocate Tushar Bhosale answered.
A criminal arrest under the BNS should be treated as an urgent matter, and the first step is to obtain the FIR, arrest memo, remand papers, and details of the exact sections invoked, particularly whether the offence is bailable or non-bailable and whether it falls within the category of offences punishable with more than seven years or involves special statutes; for offences where bail is subject to stringent statutory conditions, the Court has to consider whether there are reasonable grounds for believing that the accused is not guilty and whether the accused is unlikely to commit an offence while on bail, and depending upon the facts and stage of the case, an appropriate bail application before the competent Court should be prepared without unnecessary delay.
Q2. My wife has filed a domestic violence case against me and my family. We want to settle the matter, but the police are not cooperating. What is the legal remedy?
Advocate Tushar Bhosale answered.
A matrimonial dispute involving proceedings under the Protection of Women from Domestic Violence Act, 2005 should be approached separately from the question of criminal prosecution, and the Act provides various remedies before the Magistrate including protection orders, residence-related reliefs, and monetary reliefs; if both parties genuinely wish to settle the dispute, the settlement should preferably be reduced into writing, clearly setting out the agreed terms such as maintenance, withdrawal or closure of proceedings where legally permissible, custody arrangements, and return of articles, and if criminal proceedings have also been initiated, merely informing the police that the parties have settled does not necessarily result in automatic termination of every proceeding, and depending on the nature of the offences and the stage of the matter, appropriate proceedings may have to be initiated before the competent court including a request for quashing where legally maintainable.
Q3. I want to file for mutual consent divorce. What is the procedure under the Hindu Marriage Act, and how long does it take?
Advocate Tushar Bhosale answered.
Mutual consent divorce is the fastest and least contentious way to end a marriage when both parties agree to separate, and the procedure is governed by Section 13-B of the Hindu Marriage Act, 1955, where the first step is filing a joint petition before the Family Court, following which the Court records statements of both parties and passes a first motion order, and a mandatory cooling period of six months follows which can be waived by the Court in certain circumstances, after which both parties appear again to confirm their consent and the Court passes the final decree of divorce; the normal timeline is six to eighteen months, though if the cooling period is waived, it can be completed in three to six months in exceptional cases.
