Q1. I am an accused in an FIR registered under the NDPS Act. The police have arrested me, and my family is scared. What should I do immediately to get bail?

Advocate Mohd. Sadiq Hussain answered.
An NDPS arrest should be treated as an urgent matter. The first step is to obtain the FIR, arrest memo, remand papers and details of the exact sections invoked, particularly the quantity of the alleged contraband and whether the offence falls within the restrictions of Section 37.
For offences covered by Section 37, bail is subject to stringent statutory conditions. The Court has to consider whether there are reasonable grounds for believing that the accused is not guilty and whether the accused is unlikely to commit an offence while on bail.

Depending upon the facts and stage of the case, an appropriate bail application before the competent Court should be prepared without unnecessary delay.
Practical advice: The family should not attempt to negotiate with police officers or contact alleged witnesses. Instead, immediately engage an experienced criminal/NDPS lawyer and preserve all documents, medical records, electronic evidence and other material relevant to the defense.

Q2. My wife has filed a domestic violence case against me and my family. We want to settle the matter, but the police are not cooperating. What is the legal remedy?

A matrimonial dispute involving proceedings under the Protection of Women from Domestic Violence Act, 2005 should be approached separately from the question of criminal prosecution.
The Domestic Violence Act provides various remedies before the Magistrate, including protection orders, residence-related reliefs and monetary reliefs.

If both parties genuinely wish to settle the dispute, the settlement should preferably be reduced into writing, clearly setting out the agreed terms such as maintenance/financial settlement, withdrawal or closure of proceedings where legally permissible, custody/visitation arrangements, return of articles and other mutually agreed conditions.

If criminal proceedings have also been initiated, merely informing the police that the parties have settled does not necessarily result in automatic termination of every proceeding. Depending on the nature of the offences and the stage of the matter, appropriate proceedings may have to be initiated before the competent court, including a request for quashing of criminal proceedings where legally maintainable.

The police cannot be expected to substitute themselves for the Court in deciding whether judicial proceedings should be terminated.
Practical advice: Do not sign a settlement under pressure. Have the proposed settlement examined by an independent lawyer before signing it, particularly where several proceedings are pending.

Q3. I am a builder, and a buyer has filed a case against me for delay in possession under RERA. I want to defend my case. What should I do?

Advocate Mohd. Sadiq Hussain answered.
A RERA delay-possession case should be defended on the basis of the agreement for sale, project records and actual reasons for the delay, rather than merely alleging that the delay was beyond the builder’s control.
Section 18 of the RERA Act specifically deals with the consequences where a promoter fails to complete or is unable to give possession in accordance with the terms of the agreement for sale. Depending upon the circumstances and the allottee’s choice, the statutory consequences can include refund with interest and compensation, or interest for the period of delay where the allottee continues with the project.

The promoter should also carefully examine whether the relief claimed by the allottee corresponds with the statutory framework and the facts of the particular case.
RERA proceedings are document-intensive. A well-prepared written statement/reply, supported by contemporaneous project records, is generally far more useful than a broad denial of liability.

Whether it is an NDPS arrest, matrimonial litigation or a RERA dispute, the most important step is to act at the correct stage. Delay in obtaining legal advice can affect available remedies and the defence strategy.
